It doesn't stay upright by itself, but there is an easy fix. There's a quarter-inch hole in the bottom so we got a quarter-inch metal rod about 18 inches long at the hardware store, inserted it in the bottom of the birdfeeder, and stuck it in the ground. This worked well. On the other hand, one should not have to fix a newly purchased product. The cat design tickles our funny bone and we wanted to keep it. I really can't recommend it without reservation.

THe cat with the hat bird feeder is very nice but the base needs to be larger so it can be staked in to the ground. It keeps falling over. The birds come to eat out of the feeder but then it falls over. and the seeds gets in the grass.
